29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) 268 E. Scotland Drive Bear, DE: On or about January 23, 2023, it was determined by the compliance officer that an employee who was operating a Powered Industrial Trucks [PIT] was determined not to have a valid license to operate the PIT. The previous license of the operator was expired at the time of the inspection. The PIT was being used to haul pallets of equipment/materials that were determined to weight thousands of pounds .

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: a) 268 E. Scotland Dr. Bear, DE: On or about January 23, 2025 an employees operated a Powered Industrial Trucks[ PIT] that was observed to have defective tires while moving pallets of equipment/supplies around the production area of the facility [e.g. shoulders and concrete ties] with conditions that adversely affected the safe operation of the vehicle including but not limited to, inoperable lights, no back-up alarm and a missing seat belt. No adequate pre inspection was made which would have identified the service needed of the PIT prior to its use.

29 CFR 1910.184(d):Inspections. Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service. a) 268 E. Scotland Drive Bear, DE. 19711 - On or about February 13, 2025, it was observed by the compliance officer that the condition of the synthetic mesh slings used to pull a steel cart containing iron "shoulders" totaling approximately 250 pounds in weight was observed as being tattered. The slings being used repeatedly showed extensive damage. Routine inspections were not being conducted prior to use.
