29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: (a)Thermo Bond Buildings, LLC. at 1001 West Main Street, Elk Point, SD 57025: On or about and at times prior to February 13, 2025, the employer did not perform a hazard assessment for respirable crystalline silica exposure as employees were performing residual concrete removal from pre-cast concrete walls. This condition exposed employees to potential over exposure to respirable crystalline silica.
