OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the crushing hazard of being caught under and/or struck-by a toppling pile driver. Location: a) Worksite: located at the rear of the existing building's yard at 145 Brooklyn Avenue, Brooklyn, NY 11213: On or around February 13, 2025, employees were exposed to the hazard of being struck-by/caught under a toppling pile driver while utilizing it to install soldier piles for the retaining wall. The pile driver operated on soil affected by melted snow, saturating the ground with water and creating an unstable condition for the pile driver's operation. The supporting materials used were insufficient to support the pile driver.
