29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Toro Groundsmaster 4500D lawnmower (Model 30881/Serial# 404830992 - 105dB): On or about February 5, 2025, and time prior, the employer exposed employees to noise hazards in that the employer did not develop and implement a hearing conservation program as recommended by the manufacturer of the Toro lawnmowers used by employees to perform lawncare services. b) Toro Groundsmaster 3100D lawnmower: On or about February 5, 2025, and time prior, the employer exposed employees to noise hazards in that the employer did not develop and implement a hearing conservation program as recommended by the manufacturer of the Toro lawnmowers used by employees to perform lawncare services. c) Stihl backpack blower: On or about February 5, 2025, and time prior, the employer exposed employees to noise hazards in that the employer did not develop and implement a hearing conservation program as recommended by the manufacturer of the Stihl backpack blower used by employees to perform lawncare services. d) Stihl Chainsaw (MS291): On or about February 5, 2025, and time prior, the employer exposed employees to noise hazards in that the employer did not develop and implement a hearing conservation program as recommended by the manufacturer of the Stihl chainsaw used by employees to perform lawncare services.
