29 CFR  1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) Metal Finishing Systems, Inc. located at or near 240 Welsh Pool Road, Exton, PA 19341: The employer did not make available audiometric testing for employees engaged in the fabrication of sheet metal products and exposed to continuous noise levels equivalent to 98.1% of the allowable 50% dose for an 8 hour time-weighted average (TWA). An employee operating a TIMESAVERS 3100 Finishing Machine and performing welding activities throughout their shift was exposed to noise levels equivalent to an 8 hour TWA of 89.8 dBA, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. The sampling time was 423 minutes. Zero exposures were assumed for all unsampled time periods.   Violation noted on April 29, 2025.

29 CFR  1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  a) Metal Finishing Systems, Inc. located at or near 240 Welsh Pool Road, Exton, PA 19341: The employer did not provide training to an employee engaged in the fabrication of sheet metal products and exposed to continuous noise levels equivalent to 98.1% of the allowable 50% dose for an 8 hour time-weighted average (TWA). 29 CFR  1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200 paragraphs (f), (g), and (h) for labels and other forms of warning, safety data sheets, and employee information and training would be met:  a) Metal Finishing Systems, Inc. located at or near 240 Welsh Pool Road, Exton, PA 19341 - On or about February 13, 2025, a written Hazard Communication Program was not provided where employees are exposed to hazardous chemicals while performing sheet metal fabrication activities. Employees are exposed to hazardous chemicals including but not limited to the following:  -Severely-hydrotreated naphthenic distillates and C14-C17 medium chain chlorinated paraffin, as contained in CIMCOOL MILFORM 645 stamping and drawing fluid. -Silicon, manganese, and iron, as contained in National Standard NS ARC NS-115 Carbon Steel Welding Wire. -Iron, aluminum, manganese, silicon, vanadium, and nickel, as contained in ArcelorMittal Hot Rolled or Cold Rolled Steel. -etc.
