29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) On and before February 14, 2025, and at times prior, employees were required to wear powered air purifying respirators and supplied air respirators during paint spraying operations. The employer did not implement all required elements of a Respiratory Protection Program that would include, but is not limited to: (1) medical evaluations for employees required to wear tight-fitting respirators, (2) fit testing for employees required to wear tight-fitting respirators, (3) training for employees regarding the hazards they may encounter during the required use of respirators, (4) training for employees regarding the limitations of respirators they are required to use, and (5) procedures for evaluating the effectiveness of the Respiratory Protection Program. This exposed employees to potential pulmonary and cardiovascular hazards due to the use of respirators.

29 CFR  1910.134(d)(1)(iii):The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  a) On and before February 14, 2025, and at times prior, employees were exposed to potentially carcinogenic chemicals (e.g. Permahyd Hi-Tec Mixing Color Bright Blue, Permahyd Hi-Tec Mixing Color Special Black, Permahyd Hi-Tec Mixing Color White, etc.). The employer did not evaluate the potential respiratory hazards at the workplace to ensure employees are not overexposed to air contaminants such as acetone, butanone, butyl acetate, ethylbenzene, pentanol, petroleum naphtha solvent, propanol, trimethyl benzene, and xylene. This exposed employees to potentially hazardous chemical inhalation hazards.

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present using an identity that was referenced on the appropriate material safety data sheet:  a) On and before February 14, 2025, and at times prior,  the employer's written hazard communication program did not include a list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate safety data sheets.  Employees were exposed to potentially carcinogenic chemicals (e.g. Permahyd Hi-Tec Mixing Color Bright Blue, Permahyd Hi-Tec Mixing Color Special Black, Permahyd Hi-Tec Mixing Color White, etc.)and hazardous chemicals such as, put not limited to, acetone, butanone, butyl acetate, ethylbenzene, isocyanates, pentanol, petroleum naphtha solvent, propanol, trimethyl benzene, and xylene. This exposed employees to potentially hazardous chemical inhalation and skin hazards.
