29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  At the countertop fabrication area, employees engaged stone cutting activities are required to use a 3M half-face respirator pulmonary and a written respiratory protection program has not been developed. Respirators can cause  cardiac stress hazards.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  At the countertop fabrication area, an employee is exposed to pulmonary hazards and/or cardiac stress hazards when using employer required half-face respirators without having been provided a medical evaluation prior to use.

29 CFR  1910.134(h)(2)(i):Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  At the countertop fabrication area, employees were exposed to respiratory irritation and chemical hazards. The employer failed to ensure all 3M half-face respirators were properly stored. Respirators were stored on a wall, on the south side of the fabrication area, and were not protected from stone residue or dust which may cause respiratory tract, skin and eye irritation.

29 CFR  1910.132(d)(2):The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done:  On or about November 22, 2021, the employer did not certify in writing that a hazard assessment was completed. Employees including, but not limited to, those in the countertop fabrication area were provided personal protective equipment to include hearing protection, N-95s, half-face respirators, safety glasses and hard hats.

29 CFR  1910.178(l)(6):The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  At the countertop fabrication area, employees were exposed to struck-by hazards.  Employees are permitted to operate the Toyota forklift without a certification that contained the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.
