29 CFR  1910.134(c)(2)(ii): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user:  On or about February 28, 2025; at a facility located at 600 Liberty Street in Green Bay, WI; the employer did not have a written respirator protection program for an employee that voluntarily wore a negative-pressure tight-fitting half-face elastomeric respirators during housekeeping activities that involved blowing down paper/plastic dust and debris from building structures and equipment.

29 CFR  1910.134(e)(1): The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is allowed to use the respirator voluntarily in the workplace:  On or about February 28, 2025; at a facility located at 600 Liberty Street in Green Bay, WI; the employer did not provide a medical evaluation to determine if an employee was able to use a respirator when the employee voluntarily wore a negative-pressure tight-fitting half-face elastomeric respirators during housekeeping activities that involved blowing down paper/plastic dust and debris from building structures and equipment.

29 CFR  1910.134(k)(6):  The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer:  On or about February 19, 2025; at a facility located at 600 Liberty Street in Green Bay, WI; the employer did not present the basic advisory information contained in Appendix D of this section to employee who were allowed to use N95 filtering facepiece  (dust mask) respirators voluntarily. Employees voluntarily utilized Moldex 4200 N95s approximately twice per shift while blowing down paper/plastic dust and shreds from shredding and pelletizing equipment.
