29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  (a)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not develop machine specific procedural steps for shutting down, isolating, placement, removal, and transfer of lockout devices and specific requirements for testing machines or equipment to determine and verify the effectiveness of lockout devices and other energy control measures to prevent employee injury during maintenance or servicing of multi-energy source powered equipment to include, but not limited to, the Costa "Timesaver" vertical belt sander, model: KA00001350, s/n: A40421AG1.  This condition exposed employees to caught-in and amputation hazards associated with the unexpected energizing, startup or release of stored energy.

29 CFR  1910.213(d)(1): Circular handfed crosscut table saw(s) were not guarded by an automatically adjusting hood which completely enclosed that portion of the saw above the table and above the material being cut:  (a)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure the Lauderdale Hamilton Super Cut Upcut Saw in the rough mill area was guarded by an automatically adjusting hood.  This condition exposed the employees to an amputation hazard.

29 CFR 1910.213(r)(3): The point of operation on combination or universal woodworking machines was not guarded as required for such a tool in a separate machine:   (a)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure the point of operation on the Komo CNC "Komo 3", model VR 510 Mach 25, s/n: 51610-07-01-05 was properly guarded to prevent employees from having any part of their body in the danger zones during machine operations. This condition exposed employees to caught-in, crushing, and amputation hazards.  (b)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure that the point of operation on the Lauderdale Hamilton Super Cut Upcut Saw located in the rough mill area  was properly guarded to prevent employees from having any part of their body in the danger zone during specific machine operations. The dual hand controls provided by the manufacturer had been removed and replaced with a foot treadle. This hazard exposed employees to amputation hazards.  (c)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure that the point of operation on the Whirlwind "Tiger Stop" Up Cut Saw located in the drawers area was properly guarded to prevent employees from having any part of their body in the danger zone during specific machine operations. The dual hand controls provided by the manufacturer were no longer functional and allowed single-hand operation.  This hazard exposed employees to amputation hazards.

29 CFR  1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:  (a)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure that operating pressures for compressed air were less than 30 p.s.i, for cleaning purposes.  An air hose used to clean the "Dovetailer" located in the "Drawers" department was measured at 100 p.s.i. This condition exposed employees to flying debris hazards as well as pulmonary embolisms.  (b)Dakota Kitchen & Bath, Inc. at 4101 North Hainje Avenue, Sioux Falls, SD 57104:  On or about and at times prior to February 20, 2025, the employer did not ensure that operating pressures for compressed air were less than 30 p.s.i, for cleaning purposes.  An air hose used to clean the "Komo 1" CNC machine located in the "Parts" department was measured at 108 p.s.i. This condition exposed employees to flying debris hazards as well as pulmonary embolisms.
