OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck-by and caught-in hazards created by moving/rolling railcars which could result in crushing injuries, amputation, and/or death. (a) On or about January 31, 2025, Azcon Metals, Inc. did not ensure that employees were protected from struck-by and caught-in hazards while cutting (uncoupling) a Gondola scrap car from a line of railcars (flats), which were connected to remote-controlled Locomotive 80 in the Castor Building. The employees stepped in between a flat railcar and the scrap railcar to uncouple them, without first securing them from movement when entering the red zone (danger zone). (b) On or about June 4, 2025, Azcon Metals, Inc. did not ensure that employees were protected from struck-by and caught-in hazards while coupling railcars, which were connected to remote-controlled Locomotive 80 in the Castor Building. The employees stepped in between a flat railcar and a Gondola scrap railcar to access a malfunctioning cut lever on the flat, without first securing it from movement when entering the red zone (danger zone). Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
