The employer did not establish and implement a written respiratory program. Employees are required to use half face respirators or dust masks during work tasks in the shop, including but not limited to cutting, polishing, and buffing granite and quartz countertops.

29 CFR  1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:  At the worksite located 14184 Butternut Lane Carthage MO: Employees were exposed to chemical and respirable hazards in the form of respirable crystalline silica in excess of the OSHA Permissible Exposure Limit (PEL) 50 ug/m3, calculated as an 8-hour TWA. This was shown in three employees:   a.) One employee, a Saw Operator, had an exposure of 102ug/m3 with a sampling time of 229 minutes. The remaining un-sampled period of 251 minutes is assumed to have zero exposure. b.) One employee, a Foreman, had an exposure of 86.0 ug/m3 with a sampling time of 385 minutes. The remaining un-sampled period of 95 minutes is assumed to have zero exposure. c.) One employee, a Polisher, had an exposure of 67.6 ug/m3 with a sampling time of 383 minutes. The remaining un-sampled period of 97 minutes is assumed to have zero exposure.

The employer did not use engineering and work practice controls to reduce employee exposure below the Permissible Exposure Limit (PEL) for respirable crystalline silica. This was recently shown on March 5, 2025, when three of five employees sampled had exposure levels greater than the PEL.
