29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  On or about February 25, 2025, at the worksite located at 1705 Founders Street, Neenah, Wisconsin; the employer did not ensure that an employee working on a scaffold greater than 10 feet above a lower level performing siding work was protected from falls, exposing an employee to fall hazards. The height of the scaffold was greater than 12 feet above a lower level.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about February 25, 2025, at the worksite located at 1705 Founders Street, Neenah, Wisconsin; the employer did not ensure that an employee working near an unprotected side or edge while performing siding work on the roof was protected from falls, exposing an employee to fall hazards. The height of the roof edge where the employee was working was greater than 10 feet above a lower level.   Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
