29 CFR  1926.1403(a): When assembling or disassembling equipment (or attachments), the employer must comply with all applicable manufacturer prohibitions and must comply with either: Manufacturer procedures applicable to assembly and disassembly, or 1926.1403(b) Employer procedures for assembly and disassembly.   (A)  When assembling or disassembling equipment (or attachments), the employer did not comply with all applicable manufacturer prohibitions and/or did not comply with procedures applicable to assembly and disassembly as required.   The incident occurred at the new batch plant erection site, which is next to the Turner plant, located at 7123 Madison Road  Thompson, Ohio 44086. Employees from R.W. Sidley, Inc and Parking Structures Services, Corp. were assembling a Link-Belt LS-218H II lattice boom crawler crane for the erection of a new batch plant. The employer did not follow the manufacturer's instructions or develop instructions under (b) of this section for adding a boom insert onto the main boom of the crane, thereby exposing the employees to a struck-by and/or caught-between hazard.  On or about January 29, 2025, employees were preparing to insert a 40 foot boom section on a Link-Belt LS-218H II lattice boom crawler crane. Two pins of the boom section had been released prior to fastening the mast to the cranes superstructure or blocking the crane which caused the boom cantilevers to fall approximately two and a half feet to the ground striking an employee resulting in serious bodily injury.

29 CFR  1926.1404(a)(1): Assembly/disassembly must be directed by a person who meets the criteria for both a competent person and a qualified person, or by a competent person who is assisted by one or more qualified persons ("A/D director").   The incident occurred at the new batch plant erection site, which is next to the Turner plant, located at 7123 Madison Road  Thompson, Ohio 44086. Employees from R.W. Sidley, Inc and Parking Structures Services, Corp. were assembling a Link-Belt LS-218H II lattice boom crawler crane for the erection of a new batch plant. There was no documentation provided that showed an A/D director was onsite working with the employees who were assembling and disassembling the boom section. The employees did not follow procedures to include securing mast to the superstructure or blocking the crane; thereby exposing the employees to a struck-by and/or caught-between hazard.    On or about January 29, 2025, employees were preparing to insert a 40 foot boom section on a Link-Belt LS-218H II lattice boom crawler crane. Two pins of the boom section had been released prior to fastening the mast  to the superstructure or blocking the crane which caused the boom to fall approximately two and a half  feet to the ground striking an employee resulting in serious bodily injury.

29 CFR  1926.1404(d)(1):Before commencing assembly/disassembly operations, the director must ensure that the crew members understand all of the following:  The incident occurred at the new batch plant erection site, which is next to the turner plant, located at 7123 Madison Road  Thompson, Ohio 44086. Employees from R.W. Sidley, Inc and Parking Structures Services, Corp. were assembling a Link-Belt LS-218H II lattice boom crawler crane for the erection of a new batch plant. The employer did not ensure that crew members  understood the tasks, the hazards associated with their tasks, and the hazardous positions/locations that they need to avoid when removing pins from the boom section, thereby exposing the employees to a struck-by and/or caught-between hazard.  On or about January 29, 2025, employees were preparing to insert a 40 foot boom section on a Link-Belt LS-218H II lattice boom crawler crane. Two pins of the boom section had been released prior to fastening the mast  to the superstructure or blocking the crane which caused the boom to fall approximately two and a half  feet to the ground striking an employee resulting in serious bodily injury.

The incident occurred at the new batch plant erection site, which is next to the turner plant, located at 7123 Madison Road  Thompson, Ohio 44086. Employees from R.W. Sidley, Inc and Parking Structures Services, Corp. were assembling a Link-Belt LS-218H II lattice boom crawler crane for the erection of a new batch plant. The employer did not ensure that work rules were effectively communicated to crew members when performing the tasks of removing pins of the boom section.  On or about January 29, 2025, employees were preparing to insert a 40 foot boom section on a Link-Belt LS-218H II lattice boom crawler crane.
