Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees not wearing seatbelt when operating a forklift were exposed to crushed-by hazards:   Warehouse floor: An employee did not use the provided manufactured restraining device while operating the forklift to move pallets in the warehouse. The employee was exposed to crushed-by and struck-by hazards.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  a. Light switch near the main entrance: The galvanized switch box, intended to be mounted in a wall was installed above a metal beam to where open knockout holes on the side of the box exposed employees to electrical and fire hazards.   b. Freezer southwest corner of warehouse: An orange extension cord, intended for temporary usage, was used to permanently power a freezer exposing employees to electrical and fire hazards.  c. Refrigerator in the office: Power to the refrigerator was permanently supplied using an orange extension cord, intended for temporary usage, exposing employees to electrical and fire hazards.
