29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 feet of the truck still in his view, the load engaging means was not fully lowered, controls neutralized and the brakes set to prevent movement. a) On February 27, 2025, Employees working at Rust Sales located at 2964 164 Avenue Southeast in Harwood, North Dakota, in shop #1 were exposed to struck by and/or crushing hazards when a forklift was being used to lift a grain auger was not fully lowered while the operator was dismounted from the forklift. b) On February 27, 2025, Employees working at Rust Sales located at 2964 164 Avenue Southeast in Harwood, North Dakota, shop #3 were exposed to struck by and/or crushing hazards when a forklift was being used to lift a grain auger was not fully lowered while the operator was dismounted from the forklift.
