29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) On or about 02/28/2025 in the warehouse area of facility located at 1777 East Henrietta Rd in Rochester NY; employer did not evaluate operators' performance of three employees who operated forklift trucks, such as, but not limited to, a Toyota Sit Down Forklift. Last forklift trucks evaluations were conducted on 2021. Employees operating forklift trucks to load pallets and boxes were exposed to struck by hazards. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment: a) On or about 02/28/2025 in the production floor of facility located at 1777 East Henrietta Road, Rochester, NY 14623; materials and equipment on a pallet were stored in front of a 240 volt electrical panel, used to power the facility and other equipment, blocking its access in case of an emergency. Employees were exposed to struck by hazards. NO ABATEMENT CERTIFICATION REQUIRED
