29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:   a) 80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY)  - High School Building Under Construction - 3rd Floor:   On or about 2/28/25, employees were not were not protected from falling from the 3rd floor  to the 2nd floor through a hole in the 3rd floor concrete floor slab walking surface.  b) 80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY)  - High School Building Under Construction - 3rd Floor:   On or about 2/28/25,  employees were not were not protected from falling from the 3rd floor to the 2nd floor through a hole in the 3rd floor concrete floor slab walking surface in which a ladder was sticking out from.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:  80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY)  - High School Building Under Construction:  On or about 3/4/25, employees tying in rebar to dowels at the edge of the roof were exposed to a fall hazard (approximately 40 feet) as the top rails of the perimeter guardrail system was approximately 52 to 54 inches in height.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high:  80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY)  - High School Building Under Construction:  On or about 3/4/25, employees tying in rebar to dowels near the edge of the roof were exposed to a fall hazard (approximately 40 feet) as the midrails of the perimeter guardrail system ranged from approximately 33 inches to 36 inches in height.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.1053(b)(9): The area around the top and/or bottom of (a) ladder(s) was not kept clear:   80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY)  - High School Building Under Construction - Third Floor to Rooftop:    On or about 3/9/25, the area around the top of a ladder used by employees to access the rooftop was not kept clear due to the existence of a guardrail running over the top of the ladder that was being used as perimeter guarding  for the floor hole on the roof through which the ladder extended.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
