OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, fall, crushing and electrocution hazards:  a)  On or about November 3, 2024, the employer did not ensure an employee was protected from struck-by, fall, crushing, and electrocution hazards while operating a Skyjack SJ86 T telescopic aerial lift.  After the platform was raised to approximately 25 feet, the aerial lift tipped over and contacted the nearby energized 12kV conductors.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to an electric power circuit that the employee could contact in the course of work and was not protected against electric shock by de-energizing the circuit and grounding it or by guarding it effectively by insulation or other means:  a)  On November 3, 2024 the employer did not ensure an employee was protected from electrocution hazards while painting a four-story multi-family residential building while operating a Skyjack SJ86 T telescopic boom, in the vicinity of  energized 12kV conductors. This condition exposed employees to electrocution hazards.

29 CFR  1926.416(a)(3): The employer began work without determining if employees could contact any part of an energized circuit and did not post warning signs and advise employees of the location of the circuit, hazards, and protective measures they need to take:   a) On November 3, 2024, the employer did not ensure employees were protected from electrical hazards in that, the employer did not determine if employees would come in contact with overhead energized conductors. The employer failed to post warning signs to advise employees of hazardous locations while painting a four-story building while working on a Skyjack SJ86 T telescopic boom, in the vicinity of energized 12kV conductors.

This condition exposed an employee to falls, crushing, stuck-by and electrocution hazards.
