29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) On or about February 24, 2025, at the worksite located at 1641 North Honeysuckle Circle, De Pere, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards. Subcontractor employees were exposed to fall hazards while performing residential construction work on a roof without fall protection and working on a platform without guardrails. The eave height of the roof was greater than 11 feet above a lower level and the roof pitch was approximately 6/12.

29 CFR  1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a) On or about February 24, 2025, at the worksite located at 1641 North Honeysuckle Circle, De Pere, Wisconsin; the employer did not ensure that a subcontractor employee exposed to fall hazards of over 11 feet while conducting work on a platform was protected by a guardrail system.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) On or about February 24, 2025, at the worksite located at 1641 North Honeysuckle Circle, De Pere, Wisconsin; the employer did not ensure that each subcontractor employee performing framing work was protected from falls, exposing subcontractor employees to fall hazards. The eave height of the roof was greater than 11 feet and the roof pitch was approximately 6/12.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
