29 CFR  1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems that were used:  Site: 133-25 37 AVENUE, Flushing, NY 11354. a). On or about March 03, 2025, and at times prior thereto, during facade/balcony dividers installation on a 16-story building, BCG Glass Industry Inc. failed to assure employees using personnel fall protection systems such as K-Strong UAF30090, Werner A510000 anchors, and Palmer Safety 8 feet Self-Retractable Lanyard were trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting of these systems. The employees were working on exterior balconies that were not guarded and exposed to fall hazards of up to 100 feet.

29 CFR 1926.503(b)(1): The employer did not prepare a written certification record containing the name or other identity of employee trained, the date(s) of the training,  and the signature of the person who conducted the training:  Site: 133-25 37 AVENUE, Flushing, NY 11354. a). On or about March 03, 2025, and at times prior thereto, BCG Glass Industry Inc. failed to provide certification of training for employees that were using personal fall protection systems such as; UAF30090, Werner A510000 anchors, and Palmer Safety 8 feet Self-Retractable Lanyard were trained by a competent person in the installation, use, and operation of these systems.

29 CFR 1926.503(c)(3): Affected employee(s) were not retrained after their knowledge or use of fall protection systems or equipment indicated that the employee has not retained the requisite understanding or skill.   Site: 133-25 37 AVENUE, Flushing, NY 11354. a). On or about March 03, 2025, and at times prior thereto, BCG Glass Industry Inc. failed to retrain employees who were found working from the unprotected sides and edges of the balcony platform, without a fall protection system, at an approximate height of 10 to 100 feet from the ground below. These employees were also observed attaching multiple self-retracting lifelines to a single anchor point. These deficiencies expose the employees to fall hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Site: 133-25 37 Avenue, Flushing, NY 11354. a). On or about March 03, 2025, and at times prior thereto, BCG Glass Industry Inc. employees engaged in metal panel installation on a balcony divider were exposed to a fall of approximately 10 to 100 feet from an unprotected side or edge. The employer did not ensure each employee was protected from falls by the use of  fall protection systems.  Note: BCG Glass Industry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1772435, citation number, 1 item number 1 and was affirmed as a final order on 02/11/2025, with respect to a workplace located at 5722 7th Ave Brooklyn, NY 11220.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 KN) per employee attached:    Site: 133-25 37 Avenue, Flushing, NY 11354.  a). On or about March 03, 2025, and at times prior thereto, BCG Glass Industry Inc., two employees engaged in metal panel installation on balcony dividers located approximately 10-100 feet above the ground below were connected to the same anchor point as part of their fall protection systems. The K-Strong UAF30090 and Werner A510000 anchors the employees were using were only rated for 5, 000 pounds per person attached, and exposed the employees to falling hazards.
