29 CFR 1926.453(b)(2)(v): A body belt (harness) shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  a) On or about 03/04/2025, during the process of water proofing and application of exterior sheathing at the Quicklee's convenient store under construction, located on 1950 Monroe Avenue, in Rochester, New York, the employer did not enforce the use of fall protection while working in the basket of an aerial boom lift 10 feet above lower levels.   The lift operator was allowed to work in an aerial lift without utilizing a Personal Fall Arrest Systems such as "tying off" to the boom basket with a harness and lanyard.    NO ABATEMENT CERTIFICATION REQUIRED
