An employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On March 06, 2025, at an apartment complex located at 1120 South 3rd Street in Bismarck, North Dakota, employees were exposed to fall hazards over six feet while constructing a wood deck on the north unit without fall protection systems in place. b) On March 06, 2025, at an apartment complex located at 1120 South 3rd Street in Bismarck, North Dakota, employees were exposed to fall hazards over six feet while constructing a wood deck on the south unit without fall protection systems in place.

29 CFR 1926.1053(b)(1):When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: (a) On March 6, 2025, at an apartment complex located at 1120 South 3rd Street in Bismarck, North Dakota, while installing a�wood deck, the employee was permitted to continuously utilize a ladder that did not reach three feet or more above the landing surface.
