29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary: (a) On or about March 6, 2025, an employee working while standing on the second tier of tubular welded end frame scaffolding was not protected from a falling in that it was not fully planked. (b) On or about March 6, 2025, an employee working while standing on the extension of tubular welded end frame scaffolding was not protected from a falling in that it was not fully planked. (c) On or about March 6, 2025, an employee working while standing on the first tier of tubular welded end frame scaffolding was not protected from falling in that it was not fully planked.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: (a) On or about March 6, 2025, at least one employee was not protected from falling up to approximately fourteen (14) feet to the ground below in that they were accessing the second tier of tubular welded end frame scaffolding by using the end frames and cross braces. (b) On or about March 6, 2025, at least one employee was not protected from falling up to approximately fourteen (12) feet to the ground below in that they were accessing the extension of tubular welded end frame scaffolding by using the end frames and cross braces.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about March 6, 2025, an employee working to install masonry from tubular welded end frame scaffolding was not protected from falling: (a) An employee was working while on the 2nd tier that had no railing. (b) An employee was working while on the extension that had no end rails.
