OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees caused by unsafe racking systems:  a) 1 Industrial Drive Birdsboro, PA: On or about March 7, 2025, the storage rack system used to store tires sustained damage to the shelf decking on the first and second tiers at numerous locations throughout the warehouse. This damage was neither repaired nor marked as out of service, and the storage rack system lacked a weight rating.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) 1 Industrial Drive Birdsboro, PA: On or about March 7, 2025, an employee accessed the elevated working surface to retrieve a vehicle tire, which was approximately 16 feet off the ground, the storage rack was not equipped with a guardrail or other fall protection method.
