OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  a) Fill Plant: On or about March 11, 2025, the employer failed to provide route drivers with sufficient training and information regarding pressure relief valves to prevent struck by hazards while transferring liquid nitrogen from bulk storage tanks to transport tanks.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) Fill Plant: On or about March 7, 2025, the employer did not report an employee hospitalized as a result of the loss of an eye within 24 hours of the work-related incident. The event occurred on March 7, 2025 at approximately 7:55 AM and OSHA was not notified until March 10, 2025 at 4:30 PM.
