The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section):  (a)CHS Inc., dba CHS Inc. of Minnesota dba CHS River Plains at 1510 3rd Avenue, Selby, SD 57472: On or about and at times prior to March 10, 2025, the  employer did not ensure employees were protected from fall hazards when performing work on the first level platform of the South Tower in that the top edge height of the guardrail system around the floor opening for the mixers on the South Tower was  42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The guardrail system consisted of a single rail at a height approximately 31 inches above the walking working surface of the platform. This condition exposed employees to fall hazards.   Abatement Note: Guardrail systems include midrails, screens, mesh, intermediate vertical members, solid panels or equivalent intermediate members in addition to top rails or equivalent members.
