29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): (a)Brothers Millwrights, LLC at 1510 3rd Avenue, Selby, SD 57472: On or about and at times prior to March 10, 2025, the creating employer removed two approximate 36 inches x 42 inches sections of flooring from the 1st level platform of the South Tower to support construction activities. Brothers Millwrights, LLC failed to ensure effective steps were taken to reduce host employees exposures to fall hazards when on the 1st level platform of the South Tower. This condition exposed host employees to fall hazards greater than four feet.
