29 CFR 1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: On or about March 26, 2025, it was documented that employees performing material handling activities in buildings 3 and 4 of the Nebraska Warehouse Company, LLC located at 10064 South 134th Street, Omaha, Nebraska were exposed to struck-by and caught under hazards in that the employer failed to document through a certification that includes the name of the operator, name of the trainer, date of formal training and the date of evaluation prior to allowing personnel to operate powered industrial trucks.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about March 12, 2025, it was observed that employees performing material handling activities in buildings 3 and 4 of the Nebraska Warehouse Company, LLC located at 10064 South 134th Street, Omaha, Nebraska were exposed to struck-by and caught under hazards in that the employer did not remove defective powered industrial trucks from service. Instances included but were not limited to: i. Jungheinrich ETV 214 reach stacker, serial number 91095861, the previously installed seatbelt assembly was missing the seat belt strap rendering it inoperable, ii. Jungheinrich ETV 214 reach stacker, serial number 91073773, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, iii. Jungheinrich ETV 214 reach stacker, serial number 91073772, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, vi. Jungheinrich ETV 214 reach stacker, serial number 91061315, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, and v. Jungheinrich RTV 214 reach stacker, serial number 91065332, the previously installed seatbelt assembly was missing a buckle rendering it inoperable.

29 CFR 1910.165(b)(5): Procedures were not established for sounding emergency alarms in the workplace: On or about March 26, 2025, it was documented that employees performing material handling activities in Buildings 3 and 4 of Nebraska Warehouse Company, LLC located at 10064 South 134th Street, Omaha, Nebraska were exposed to fire hazards in that the employer did not adequately establish and/or communicate concise procedures for sounding emergency alarm(s). Adequacy instances included but were not limited to: i. Emergency alert method(s) included in the written Emergency Fire Evacuation Plan that were not available in the workplace identified in the plan and ii. Contradictory directions/instruction in the written Emergency Fire Evacuation Plan on how to notify personnel in case of a fire or other emergency.
