OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from riding a wooden pallet raised by a forklift in order to get material off of a racking system. Location: Warehouse area of M. Cutone Mushroom Company, Inc. On or about March 8, 2025, an employee of M. Cutone Mushroom Company, Inc. was exposed to fall hazards while being lifted on a wooden pallet, on the forks of a forklift, in order to retrieve a case of bottles from the top level of a racking system.
