29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:   (a) On or about 03/12/2025 - 369 Florida Rd., Pell City, AL: the employer exposed employees to potential eye injuries when employees operating framing nailers were not wearing eye protection.    Samuel Caldera Jimenez was previously cited for a serious violation of this Occupational Safety and Health Standard 29 CFR 1926.102(a)(1), which was contained in OSHA Inspection Number 1645049, citation number 1, item number 1 and was affirmed as a final order on 2/22/2023, with respect to a workplace located at  Lot 73 Sussex Road, Margaret, AL 35112.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about 03/12/2025 - 369 Florida Rd., Pell City, AL: the employer exposed employees to fall hazards, in that fall protection was not utilized by employees while performing framing work.   Samuel Caldera Jimenez was previously cited for a serious violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1645049, citation number 1, item number 2 and was affirmed as a final order on 2/22/2023, with respect to a workplace located at  Lot 73 Sussex Road, Margaret, AL 35112.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
