On or about March 13, 2025, on the west side of the jobsite at building #1, employees working from a balcony platform were not protected from falling 6-feet or more to the next ground level by the use of guardrail systems, safety net systems, or personal fall arrest system.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. On or about March 13, 2025, on the west side of the construction project at building #1, a telehandler being utilized by employees did not meet the applicable requirements as defined in the American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks in the following instances. a) The PIT operator left the PIT unattended with the forks in the elevated position. b) The employer did not maintain daily pre-operation inspections that included checking tire condition and pressure. The tires on the PIT had visible cuts, gouges, and uneven tire pressure.
