29 CFR  1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a.  On or about March 10, 2025, at the above addressed jobsite, employees were exposed to hazards associated with unsafe powered industrial vehicle operations while lifting rebar with the direct placement of rigging equipment (i.e., sling) onto the tine of a Pettibone T944x Telehandler for a below-the-tines lift, which could affect the capacity and/or safe operations of the equipment.  The employer did not receive written approval from the manufacturer of the equipment before using the sling.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  a.  On or about March 10, 2025, at the above addressed jobsite, employees were using a table saw to cut concrete masonry units that contained silica.  The employer did not fully and properly implement engineering controls that effectively minimized dust exposure, thereby exposing the employees to hazards associated with respirable crystalline silica.
