29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it was infeasible or created a greater hazard to use these systems and develop and implement a fall protection plan which met the requirements of paragraph (k) of section 1926.502: a) Worksite was located at 307 Barkentine Lane, Mantoloking, NJ 08738 Two workers exposed to fall hazards over twenty feet to ground were observed working on the roof of an existing two-story home undergoing renovation while not utilizing fall protection. Violation was observed on or about March 14, 2025. b) Worksite was located at 307 Barkentine Lane, Mantoloking, NJ 08738 One worker exposed to fall hazards of approximately ten feet to ground was observed building a deck on the back of the house at the second floor height while not utilizing fall protection. Violation was observed on or about March 14, 2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
