OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to physical hazards that would necessitate the need for trained first aid providers:   Rocking T Farms, at 1403 Rd BB, Holcomb, KS: On or about March 14, 2025, the employer failed to provide employees with adequate emergency medical response associated with remote locations.  The employer failed to have a person adequately trained to render emergency medical response within 3-4 minutes after identifying an injured employee  METHODS OF FEASIBLE ABATEMENT INCLUDE BUT IS NOT LIMITED TO:  i.	Develop and implement written procedures on responding to an urgent/severe employee injury  ii.	Train the employees and staff on the procedures for responding to an urgent/severe employee injury.  iii.	Identify personnel to serve as first responders and ensure those personnel are trained in first-aid, CPR and how to use a defibrillator as well as any other critical first responder training specific to your industry.  iv.	Provide first responders with the equipment and materials to provide emergency medical treatment required until emergency rescue arrives.  v.	Ensure first responders are on site whenever employees are working.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards .  Rocking T Farms, at 1403 Rd BB, Holcomb, KS: On or about March 14, 2025, the employer failed to protect employees from fall hazards when they removed the upper railing of a Meyer 9136 silage trailer.  A Yale Veracitor forklift operator, equipped with an unguarded metal platform lifted an employee to access a work location.  This condition exposed the employee to an approximately 10-foot fall hazard.   METHODS OF FEASIBLE ABATEMENT INCLUDE BUT IS NOT LIMITED TO:  i.	Evaluate/implement engineering solutions to eliminate the hazard to include, but not limited to using rolling scaffolding or placing the trailer beside a building where employees can use a personal fall arrest system.  ii.     Follow the Yale Veracitor Forklift manual which states on page 75: Do not use truck to lift people unless there is no other practical option (scaffolds, elevated work platforms, aerial baskets, etc.) to perform the needed work. Use only a securely attached special work platform which meets or exceeds the requirements of ANSI/ITSDF B56.1.  iii.     Follow requirements established by ANSI/ITSDF B56.1. Elevating Personnel, specifically paragraphs 4.17.2 and 4.17.3 to protect personnel when working from elevated work platforms.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards.  Rocking T Farms, at 1403 Rd BB, Holcomb, KS: On or about March 14, 2025, the employer failed to prevent employee exposure to struck-by hazards related to improper use of a forklift.  An untrained forklift operator used a Yale Veracitor forklift, equipped with a chain looped over the right fork to lift and remove a 21' long, 150lbs railing from a Meyer 9136 silage trailer.  Additionally, the right fork was modified near the fork tip that allowed for the installation of a bolt through the fork. The lift configuration exposed an employee to the swing radius of the suspended load.     METHODS OF FEASIBLE ABATEMENT INCLUDE BUT IS NOT LIMITED TO:  i.	Secure forklift manufacturer approval to modify the fork or have a safety analysis completed by a certified engineer per ANSI/ITSDF B56.1 para 4.2.1 or replace the forks as a set per the Yale Veracitor operating manual.   ii.	Use an approved multi-point forklift attachment rig designed for suspended loads that meets ANSI B56.1 paragraph 4.2.3 requirements.    iii.    Reposition employees such that no one is beneath a suspended load, in accordance with manufacturer recommendations found on page 8 of the Yale Veracitor operator manual.   iv.	Provide powered industrial truck training per the manufacturer specification on page one of the manual that a qualified person, experienced in lift truck operation, must guide a new operator through several driving and load handling operations before the new operator attempts to lift the truck alone.

On March 17, 2025, the employer reported to OSHA a hospitalization that occurred on March 14, 2025. The employer did not report within the 24-hours of the hospitalization.
