29 CFR  1910.101(b):"Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6:  The employer failed to protect employees from fire, explosion, and struck-by hazards, by properly securing propane cylinders to prevent them from being knocked over, as described in  CGA Pamphlet P-1-1991 Section 3.7.4.1 which states that "All compressed gas cylinders in service or in storage shall be secured to prevent from falling." This was last observed on or about March 18, 2025 at the Hiland Dairy Foods Company, LLC warehouse facility located at 2300 Ames Ave - Omaha, Nebraska 68111 where the employer is storing forklift propane tanks against a wall in the warehouse directly adjacent to the driving lane used by the forklift operators.

29 CFR  1910.134(d)(1)(iii):The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  The employer failed to evaluate and monitor carbon monoxide levels in a warehouse located at 2300 Ames Avenue- Omaha, Nebraska 68111, exposing employee(s) to dangerous toxic exhaust gases from propane powered forklift(s). On or about March 13, 2025, an employee suffered carbon monoxide poisoning while operating a propane fueled forklift for approximately eight (8) hours in a poorly ventilated warehouse and truck trailers.

29 CFR  1910.178(q)(1): A power-operated industrial truck not in safe operating condition was not taken out of service until it was repaired by authorized personnel.  On or about March 18, 2025, warehouse employees and powered industrial truck operators/employees  were exposed to struck-by hazards such as crushing injuries at the warehouse facility located at 2300 Ames Avenue - Omaha, Nebraska 68111 in that the employer has employees operating the LP Caterpillar Forklift Model T30D with its inoperable, damaged seat belt restraint system.   It was documented that operators continued to use the forklift despite the right side belt portion having been cut/torn.
