29 CFR  1910.37(b)(2):Each exit was not clearly visible and marked by a sign reading "Exit":  a. Penthouse 1 - On or about April 24, 2025, the only door leading out of the penthouse was not marked with an "exit" sign to guide employees out of the room in the event of emergency, employees were exposed to hazards associated with delayed egress such as fire and ammonia exposures.  b. Penthouse 2 - On or about April 24, 2025, the only door leading out of the penthouse was not marked with an "exit" sign to guide employees out of the room in the event of emergency, employees were exposed to hazards associated with delayed egress such as fire and ammonia exposures.  c. Penthouse 3 - On or about April 24, 2025, the only door leading out of the penthouse was not marked with an "exit" sign to guide employees out of the room in the event of emergency, employees were exposed to hazards associated with delayed egress such as fire and ammonia exposures.  d. 29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices.  a. Outside the Engine Room - On or about March 19, 2025, the employer did not document that equipment complies with employer's chosen RAGAGEP IIAR 2-2014: Section 6.12.2 Emergency Ventilation Control when an emergency ventilation control switch for activation of emergency ventilation was not located outside the machinery room door. Failure to install an activation switch can result in employees being exposed to high levels of ammonia in the event of a release.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.119(j)(4)(ii): The inspection and testing procedures did not follow recognized and generally accepted good engineering practices    a. Engine Room - On or about March 19, 2025, the employer failed to establish and implement inspection and testing procedures that follow their chosen RAGAGEP, such as but not limited to IIAR 6-2019 Standard for Inspection, Testing and Maintenance of Closed-Circuit Ammonia Refrigeration Systems, Chapter 13 when they failed to replace or recertify the Parker relief valve, #CKR4T7RW, on the thermosyphon associated with the Compressor Package within the required five-year cycle.  Failure to maintain pressure relief devices according to RAGAGEP standards may result in these devices failing during emergencies. This could potentially lead to over-pressurization, explosions, and expose the employees to released anhydrous ammonia.  b. Engine Room - On or about March 19, 2025, the employer failed to establish and implement inspection and testing procedures that follow their chosen RAGAGEP, such as but not limited to IIAR 6-2019 Standard for Inspection, Testing and Maintenance of Closed-Circuit Ammonia Refrigeration Systems, Chapter 13 when they failed to replace or recertify the Parker relief valve I2EXZ2SX on the intercooler associated with the Compressor Package within the required five-year cycle. Failure to maintain pressure relief devices according to RAGAGEP standards may result in these devices failing during emergencies. This could potentially lead to over-pressurization, explosions, and expose the employees to released anhydrous ammonia.  c. Engine Room - On or about March 19, 2025, the employer failed to establish and implement inspection and testing procedures that follow their chosen RAGAGEP, such as but not limited to IIAR 6-2019 Standard for Inspection, Testing and Maintenance of Closed-Circuit Ammonia Refrigeration Systems, Chapter 13 when they failed to replace or recertify the Parker relief valve H3681QQ3 on the heat exchanger associated with the Compressor Package 1 within the required five-year cycle. Failure to maintain pressure relief devices in accordance with RAGAGEP can result in the failure of the relief device in the event of an emergency resulting in over pressurization, explosion and release of anhydrous ammonia.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
