29 CFR  1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) front and rear of house - On or about March 9, 2025, the employer did not provide eye protection for employees using air-actuated nail guns to fasten framing and roof sheeting to the frame, exposing employees to eye hazards.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  (a) Rear of house - On or about March 9, 2025, the employer required his employee(s) to use the all-terrain forklift with a wooden pallet on the forks that was not specifically designed by the manufacturer to lift employees, exposing employees to fall hazards.

29 CFR  1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  (a)  Rear of house - On or about March 9, 2025, the employer did not provide any fall protection for employee working from the raised platform to frame the roof, exposing employee to fall hazards.

29 CFR  1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:   (a) Front of roof - On or about March 7, 2025, the employer had employees framing a new home being built on a raised pilon piers without any means of fall protection, exposing employees to fall hazards.  XE Avila Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(2)(i), which was contained in OSHA inspection number 1724628, Citation Number 1, Item Number 1, issued on March 22, 2024, with a final order date of April 19, 2024, with respect to a workplace located at 236 West Beach, Pass Christian, MS.
