29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level: (a) Under-construction residential structure, east side exterior; On or about March 18, 2025, workers were not protected from falls while riding in a steel platform attachment placed on the forks of an Ingersoll-Rand model VR-642C all-terrain forklift to access and egress the roof at approximate heights in excess of 10-feet above ground-level.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the capacity or safe operation of the equipment were made without the manufacturer's written approval, and/or if such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: (a) Under-construction residential structure, exterior; On or about March 18, 2025, an Ingersoll-Rand model VR-642C all-terrain forklift affixed with a steel platform attachment was used to transport workers and construction materials to and from elevated locations. The forklift nor the platform were identified with capacity rating, limitations, or other information, and/or the attachment was not otherwise approved by the manufacturer for use.
