29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about March 19, 2025, the employer did not conduct adequate inspections of the job site. As a result, employees were exposed to fall heights greater than 19 feet in that conventional fall protection was not being worn while performing roofing work.

29 CFR  1926.501(b)(10):"Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a) On or before March 19, 2025, the employer failed to ensure that employees performing roofing on a commercial structure were utilizing a fall protection system. As a result, employees were exposed to fall heights greater than 19 ft.

29 CFR  1926.503(c)(3): Retraining. When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995]  a) On or about March 19, 2025, the employer did not ensure employees possessed the understanding and skill from previous fall protection training or fall hazard recognition training to utilize a fall protection system prior to performing roofing work on a low pitch roof, and were protected from a fall of greater than 19 feet.
