29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Building 3 Roof - On or about March 18, 2025 and at times prior thereto, the employer did not ensure all employees working on the roof installing tar paper were connected to fall arrest system 100% of the time while working from a roof exposing them to falls of 49.8' to the ground below. An employee fell from the roof on 3-18-2025 resulting in fatal injuries.

29 CFR 1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, and not installed under the supervision of a qualified person: a) Building 3 Roof - On or about March 18, 2025 and at times prior thereto, employees were not protected 100% by fall protection while working from a roof exposing them to falls of 49.8' to the ground below. The roof anchorages were installed inappropriately in that employer allowed workers to use 2-3 screws per side on anchors instead of minimum requirement of 6 screws per side per manufacturer (Palmer Safety - Roofing Bucket Kit).

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer did not retrain each such employee: a) Building 3 Roof - On or about March 18, 2025 and at times prior thereto, the employer did not retrain employees in fall protection hazards when inadequacies were observed in employees understanding of the training that they had previously received. Employee unhooked from fall protection system in place, walked to the ridge of the roof, and fell 49.8' to the ground below.
