29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) Located at 2025 Luvee Way, Grove City, OH 43123: On or about March 17, 2025, the employer did not train and evaluate the employee operating the JLG 1255 all-terrain forklift.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) Located at Building 3-2025 Luvee Way, Grove City, OH 43123: On or about March 17, 2025, the employer did not conduct frequent and regular inspections of the job site. As a result, employees were exposed to fall hazards greater than 9 feet, and were exposed to struck-by hazards by untrained employees operating all-terrain forklifts while performing residential construction.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Located at Building 3-2025 Luvee Way, Grove City, OH 43123: On or about March 17, 2025, the employer failed to ensure that each employee exposed to a fall hazard was trained on the hazards of falling and the procedures to minimize the hazards in the work area. As a result, employees were exposed to fall hazards greater than 25 feet while performing residential construction.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Located at Building 3-2025 Luvee Way, Grove City, OH 43123: On or about March 17, 2025, the employer did not ensure that employees framing were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 9 feet while performing residential construction.  Herrada Construction LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1774351, citation number 1, item number 1 and was affirmed as a final order on December 20, 2024, with respect to a workplace located at 311 Hayden Road, Columbus, OH 43235.
