29 CFR 1910.1053(d)(3)(i): The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area: Mixer Area and Grinding area: On or about March 20, 2025, employees exposed to respiratory hazards from silica operations were not evaluated for initial exposure to crystalline silica in the mixer and grinding area. The employer did not perform initial monitoring to assess the 8 hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area. Where an employer does representative sampling instead of sampling all employees in order to meet this requirement, the employer shall sample the employee(s) expected to have the highest crystalline silica exposures. This item was corrected during inspection.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area: Mixer Area and Grinding Area: On or about April 23, 2025, employees were exposed to chemical hazards associated with concrete product manufacturing in addition to respiratory health hazards, such as, but not limited to, crystalline silica when cutting the cast stone pieces and mixing the cement. The employer did not provide employees with effective information and training on silica and the hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
