29 CFR 1926.1101(d)(5): All general contractors on a construction project which includes work covered by this standard shall be deemed to exercise general supervisory authority over the work covered by this standard, even though the general contractor is not qualified to serve as the asbestos "competent person" as defined by paragraph (b) of this section. As supervisor of the entire project, the general contractor shall ascertain whether the asbestos contractor is in compliance with this standard, and shall require such contractor to come into compliance with this standard when necessary. a) Between March 24 and April 3, 2025, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin; the employer did not ascertain whether its demolition subcontractor Recyclean, Inc. was compliant with 29 CFR 1926.1101, and did not require its subcontractor to come into compliance. By removing bricks that were identified to have caulking, which contained approximately 2% chrysotile asbestos, Recyclean, Inc. assumed the role of an asbestos abatement contractor, and exposed their employees to the hazards associated with asbestos.

29 CFR 1926.850(a): Prior to permitting employees to start demolition operations, an engineering survey shall be made, by a competent person, of the structure to determine the condition of the framing, floors, and walls, and possibility of unplanned collapse of any portion of the structure. Any adjacent structure where employees may be exposed shall also be similarly checked. The employer shall have in writing evidence that such a survey has been performed. a) Between March 24 and April 3, 2025, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin; the employer did not adequately document the engineering survey used by their demolition subcontractor, Recyclean, Inc., exposing subcontractor employees to struck by hazards. The engineering survey did not include information, such as but not limited to a clear and detailed demolition sequence, mechanical equipment to be used, and structural stability.
