OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards associated with the lack of inspections on the two-post automotive lift: (a)Broadway Chrysler, Dodge, Jeep, Inc. at 2720 Broadway Avenue, Yankton, SD 57078: On or about and at times prior to March 20, 2025, the employer did not inspect the Rotary Lift (Hydraulic lift), Model # SP012N517, for defects in that the lift was overdue for annual inspection and had defective vehicle lift pads. This condition exposed employees to struck-by and crushing hazards. Abatement Note: Among others, the following are feasible and acceptable abatement methods to abate the hazard: 1) Institute a preventative maintenance program in accordance with ANSI/ALI ALOIM. 2) Ensure employees do not use automotive lifts with deficient safety devices. 3) Ensure unsafe lifts are effectively locked out until repairs can be made by qualified personnel.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: (a)Broadway Chrysler, Dodge, Jeep, Inc. at 2720 Broadway Avenue, Yankton, SD 57078: On or about and at times prior to March 20, 2025, employees were exposed to chemical hazards in that, not all hazardous chemicals in the workplace were labeled. Hydraulic fluid had been removed from a 30 gallon drum and replaced with Industrial - Remote Reservoir Parts Cleaner Solvent used to clean automotive parts within the parts washer. Lack of effective labeling exposed employees to injuries with improper use of chemicals and emergency procedures. This condition exposed employees to a chemical hazards.
