29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) Worksite 384 Carlls Path, Deer Park, NY - An employee on site was using a Dewalt Circular Saw to cut pieces of plywood sheathing to be installed on a roof. The employee was not utilizing safety glasses to protect his eyes from flying particles; on or about March 21, 2025.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Worksite 384 Carlls Path, Deer Park, NY - Employees on site were installing plywood sheathing on a one story residential private dwelling. The employees were not utilizing a means of fall protection and were exposed to falling approximately 10 feet to the ground below; on or about March 21, 2025.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Worksite 384 Carlls Path, Deer Park, NY - Employees on site were exposed to falling while installing plywood sheathing on a residential roof approximately 10 feet above the ground.  Employees were not trained to recognize the hazards associated with falling; on or about March 21, 2025.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
