29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  On or about March 25, 2025, during the installation of concrete block masonry for the construction of a nursing home building located at The Avenue of Stow worksite, 4249 Kent Road, Stow, Ohio, the employer failed to ensure employees working on a fabricated frame type scaffold with platforms more than 2 feet above or below a point of access (platform) were provided with a portable ladder, attachable ladder, or other safe means to access or egress between scaffold platforms.  The second level (uppermost) scaffold platforms were approximately 6 feet, 10 inches above the first level scaffold platform.  The outrigger platform was located approximately 3 feet above the first level scaffold platform.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.
