29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a) Ground Level/Cut bench: On or about 03/25/2025, the employer exposed employees to severe laceration/amputation hazards while operating a Bauer 14-inch abrasive cut off saw, in that the guard was made inoperable using a wood shim which prevented the lower guard from retracting after a cut was made while cutting brick.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.   a) Ground Level/Cut bench: On or about 03/25/2025, the employer exposed employees to respiratory hazards due to silica exposure from dry cutting masonry bricks outside without any engineering controls, work practices, or respiratory protection as described in Table-1.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) Ground Level/Cut bench: On or about 03/25/2025, and at times prior, the employer did not assess all employees who may be exposed to silica health hazards through monitoring to ensure they are not over exposed.
