29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.   The employer is failing to protect employees from fall hazards when conducting framing operations on a residential structure. This was most recently documented on or about March 25, 2025 at a residential construction jobsite located at 10304 South 109th Street, Papillion, Nebraska. The exposed employee(s) were standing on the top plates/trusses of the residential structure at heights over 6 feet and not utilizing any form of fall protection.  Pacalo Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1626193, citation number 1, item number 2 and was affirmed as a final order on 11-04-2022, with respect to a workplace located at 18086 Chutney Drive, Omaha, Nebraska.  Pacalo Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1560632, citation number 1, item number 2 and was affirmed as a final order on 12-14-2021, with respect to a workplace located at 21364 Westbury Creek, Elkhorn Nebraska.

29 CFR  1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge:  The employer is failing to protect employee(s) from fall hazards while utilizing the stairway inside a new residential construction home. This was most recently documented on or about March 25, 2025, at a residential construction jobsite located at 10304 South 109th Street, Papillion, Nebraska. Employee(s) were utilizing a stairway they constructed as means of access and egress onto the second floor. The stairway did not have a stair rail system installed for the unprotected sides.  Pacalo Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.1052(c)(1), which was contained in OSHA inspection number 1560632, citation number 1, item number 4, and was affirmed as a final order on 12-14-21, with respect to a workplace located at 21364 Westbury Creek, Elkhorn Nebraska.
