OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion/flash fire hazards: (a) On or about March 12, 2025, employees were conducting defueling operations without bonding and grounding the fuel system inside a building. This task exposed employees to the hazards associated with flash fires and explosions.

29 CFR 1910.307(c):Electrical installations. Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. (a) On or about March 12, 2025, and at times prior, the employer did not ensure employees tasked with defueling compressed natural gas (CNG) trucks performed the task in a facility with electrical installations approved for a hazardous atmosphere. This exposed the employees to explosion/flash fire hazards when CNG is released in the vicinity of electrical equipment not approved for hazardous atmospheres.

1910.101(b) "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. 29 CFR 1910.1200(h)(3)(iii): The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used. (a) On or about March 12, 2025, and at times prior, the employer did not ensure employees and managers defueling compressed natural gas (CNG) trucks utilized the (CNG) defueling procedure, and were trained on the procedure. This exposed employees to explosion/flash fire hazards when defueling compressed natural gas (CNG) trucks in an ungrounded method.
