29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  (A) A specific statement of the intended use of the procedure;  (B) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;  (C) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and  (D) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.  At an establishment located at 2600 Buchanan Street in Kaukauna, Wisconsin;   a) On or about March 27, 2025, and at times prior, the employer's documented hazardous energy control (lockout/tagout) procedure did not include specific procedural steps for controlling the hazardous mechanical (gravitational) energy when employees removed Carrier X4 7300 refrigeration (reefer) unit that was mounted on the tractor-trailer and  weighed approximately 1,690-lbs. Employees were exposed to struck and crushed-by hazards created by the sudden release of mechanical (gravitational) energy when the 1,690-lb. unit was unbolted from the tractor-trailer in order to perform servicing and maintenance tasks such as, but not limited to, replacing and servicing the exhaust manifold, and straightening the trailer's upright supports.  b) On or about March 26, 2025, and at times prior, the employer did not ensure that compliant hazardous energy control (lockout/tagout) procedures for the servicing and maintenance of Carrier X4 7300 refrigeration (reefer) units were developed, documented, and utilized by employees tasked with servicing and maintaining the units while installed on a semitrailer. As a result, employees were exposed to hazards associated with moving parts, hot surfaces, high-pressure hot fluids, and chemical-induced frostbite while performing servicing and maintenance tasks such as, but not limited to, replacing and servicing fuel lines, coolant systems, charging the refrigerant system, and replacing compressor and alternator belts. The employer's documented lockout/tagout procedures did not include:  i.  Specific shutdown procedures, verification steps, and identification of all energies present to safely deenergize the machines;  ii.  A means to control refrigerants of the reefer units (capable of causing frostbite) and pressurized hot fluids of the reefer units while performing maintenance on the refrigerant and coolant systems; iii. Specific steps to disconnect the battery and starter and prevent unexpected contact of the battery terminals, which would re-energize the system.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  (d)(1) Preparation for shutdown;  (d)(2) Machine or equipment shutdown;  (d)(3) Machine or equipment isolation;  (d)(4) Lockout or tagout device application;  (d)(5) Stored energy release; and,  (d)(6) Verification of isolation.  On or about March 27, 2025, at an establishment located at 2600 Buchanan Street in Kaukauna, Wisconsin; the employer did not ensure that all the steps outlined in 29 CFR 1910.147(d), required for the control of hazardous energy sources, were performed prior to an employee conducting servicing and maintenance activities on a Carrier X4 7300 (Serial: PAZ91384238) refrigeration (reefer) unit. An employee was exposed to struck and crushed-by hazards associated with uncontrolled falling loads when they unbolted the unit from the front of a semitrailer. The employer did not ensure that the employee blocked and secured the unit prior to allowing them to unbolt the unit from the trailer.   As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) On or about March 5, 2025, at an establishment located at 2600 Buchanan Street in Kaukauna, Wisconsin; employees operating a Yale LP forklift (Serial: E187V21010A; Model: GLC050TGNUAE082) had not been provided practical training or evaluated to determine their competency to operate the powered industrial vehicle.  b) On or about March 27, 2025, at an establishment located at 2600 Buchanan Street in Kaukauna, Wisconsin; employees operating the Capacity trailer spotting tractor (Serial No.: 10136) had not been provided formal instruction, practical training, or evaluation to determine their competency to operate the powered industrial vehicle.
